PLEASE READ THESE TERMS & CONDITIONS CAREFULLY BEFORE PURCHASING OR USING ANY GUARDCARD.COM COURSE, PRODUCT, PACKAGE, OR SERVICE.
By accessing GuardCard.com, creating an account, enrolling in a course, purchasing a product or service, or otherwise using GuardCard.com, you acknowledge that you have read, understood, and agree to be bound by these Terms & Conditions.
If you do not agree to these Terms & Conditions, do not purchase or use GuardCard.com courses, products, packages, or services.
1. GUARDCARD.COM SERVICES
GuardCard.com provides online security guard training and, for certain specifically identified products or packages, related licensing assistance and processing services.
Depending on the product purchased, services may include online training, training verification, licensing application assistance or processing, payment of applicable state application or licensing fees, fingerprinting services, required photo services, and related administrative or processing services.
Not every GuardCard.com product includes licensing-related services.
The specific products, services, fees, and benefits included in a purchase are determined by the product or package selected by the customer and its description in effect at the time of purchase.
Customers are responsible for reviewing and understanding what is and is not included with the product they select before completing their purchase.
Purchasing or completing training or licensing-related services through GuardCard.com does not guarantee issuance, approval, renewal, or maintenance of any security guard license, registration, certification, or credential.
2. TRAINING ONLY COURSES
TRAINING ONLY MEANS TRAINING ONLY.
The purchase of a GuardCard.com Training Only course includes access to the applicable online training course and training verification only.
Training Only does not include any additional licensing products, services, fees, or processing unless expressly stated otherwise in writing by GuardCard.com.
Training Only purchases do not include, but are not limited to:
- State application or licensing fees
- Preparation or submission of a state license application
- State application processing services
- Fingerprinting
- Electronic fingerprinting services
- Fingerprint cards
- Fingerprinting fees
- Background check fees
- Passport or licensing photographs
- Photo services
- Government fees
- Third-party fees
- Mailing or delivery services
- Licensing appointments
- Completion of the customer's state licensing process
A Training Only customer's purchase is fulfilled by GuardCard.com through providing the applicable training and training verification in accordance with the applicable course requirements.
Completion of a Training Only course does not mean that the customer has completed the licensing process required by their state or jurisdiction.
STATE LICENSING IS THE CUSTOMER'S RESPONSIBILITY.
Training Only customers are solely responsible for knowing, understanding, verifying, and completing the mandatory licensing process established by the state or jurisdiction in which they intend to become licensed.
Security guard licensing requirements vary by jurisdiction and may change.
Depending on the applicable state or jurisdiction, additional requirements may include applications, state fees, licensing fees, fingerprinting, background checks, photographs, identification documents, examinations, additional training, employer sponsorship, appointments, or other requirements established by the applicable licensing authority.
The customer is responsible for determining which requirements apply to them and completing those requirements.
Training Only customers are responsible for researching and verifying current licensing requirements directly with the applicable state or licensing authority.
GuardCard.com is not responsible for completing any portion of a Training Only customer's licensing process other than providing the purchased training and applicable training verification.
GuardCard.com may provide general information, instructions, links, recommendations, or other information concerning licensing procedures as a convenience to customers. Providing such information does not make GuardCard.com responsible for completing the customer's licensing process and does not change a Training Only purchase into a licensing-service or Bundle Package purchase.
Customers remain responsible for verifying that information and complying with current requirements established by their applicable licensing authority.
Completion of GuardCard.com training does not, by itself, result in issuance of a security guard license, registration, certification, or other credential.
A customer's failure to understand, research, begin, or complete the licensing process required by their state does not entitle the customer to a refund, extension, complimentary reactivation, or additional services from GuardCard.com.
3. ALL SALES ARE FINAL — NO REFUNDS
ALL PURCHASES ARE FINAL AND NON-REFUNDABLE, EXCEPT WHERE OTHERWISE REQUIRED BY APPLICABLE LAW.
This policy applies to Training Only courses, Bundle Packages, renewals, upgrades, reactivations, processing services, and other products or services purchased through GuardCard.com.
Customers are responsible for reviewing the applicable product description, included services, licensing responsibilities, eligibility requirements, access periods, and expiration periods before completing a purchase.
Failure to begin or complete training does not entitle a customer to a refund.
Failure to complete state licensing requirements does not entitle a customer to a refund.
Failure to provide requested information or documentation, schedule or attend fingerprinting, use included services before expiration, respond to communications, or otherwise complete required actions does not entitle a customer to a refund.
A change in personal circumstances, employment plans, licensing plans, relocation plans, or a decision not to pursue licensing does not entitle a customer to a refund.
A customer's misunderstanding of what is included in a Training Only course when the product was identified as Training Only does not entitle the customer to a refund.
4. 30-DAY TRAINING ACCESS
Unless expressly stated otherwise, purchase of a GuardCard.com training course provides the registered student with thirty (30) calendar days of access beginning on the original purchase date.
Training must be completed within this 30-day period.
Customers are responsible for managing their time and completing all required training before expiration.
Failure to begin training immediately after purchase does not extend the 30-day access period.
Failure to complete training within the applicable access period will result in expiration of course access.
Expiration does not entitle the student to a refund, credit, or automatic extension.
5. COURSE REACTIVATION
If training is not completed before the applicable course expiration date, payment of a reactivation fee will be required to restore access.
Reactivation fees vary by course, package, or product and are subject to the pricing and requirements in effect at the time reactivation is requested.
Reactivation is not complimentary unless expressly authorized by GuardCard.com.
Payment of a training reactivation fee does not automatically extend, restore, renew, or restart the expiration period of a Bundle Package or any included state fee, fingerprinting service, photo service, application service, processing service, or other benefit unless GuardCard.com expressly states otherwise.
6. BUNDLE PACKAGES
Bundle Packages combine training with specified licensing-related services and fees.
Depending on the Bundle Package purchased, included items may include:
- Online security guard training
- Training verification
- State application and/or licensing fees
- Licensing application processing or assistance
- Electronic fingerprinting
- Required photo services
- GuardCard.com administrative and processing services
Only the products, services, and fees expressly identified as included with the applicable Bundle Package at the time of purchase are included.
Bundle Packages are intended to assist customers with specified portions of the licensing process but do not guarantee licensing approval.
Customers remain responsible for satisfying eligibility requirements and completing any actions required of them.
7. BUNDLE PACKAGE EXPIRATION
ALL BUNDLE PACKAGE SERVICES AND FEES EXPIRE SIXTY (60) CALENDAR DAYS AFTER THE ORIGINAL PURCHASE DATE OR THIRTY (30) CALENDAR DAYS AFTER COMPLETION OF THE ASSOCIATED TRAINING, WHICHEVER OCCURS FIRST.
Customers are responsible for completing all required steps and using all included Bundle Package services and fees before the applicable expiration date.
Unused Bundle Package services and fees expire at the end of the applicable eligibility period and are non-refundable.
This includes, as applicable:
- State application or licensing fees
- Fingerprinting services or fees
- Photo services
- Application processing
- Administrative services
- Third-party services
- Other services or fees included with the applicable Bundle Package
Failure to use an included service or fee before expiration does not create a credit, account balance, refund, extension, or entitlement to future services.
Bundle Package expiration periods are not automatically extended because a customer delays completing training or other required licensing steps.
Reactivation of training does not automatically reactivate or extend expired Bundle Package services or fees.
Additional reactivation, processing, fingerprinting, third-party, state, government, or other applicable fees may be required if the customer wishes to continue the licensing process after Bundle Package services and fees have expired.
8. GOVERNMENT AND THIRD-PARTY FEES
Certain GuardCard.com products may include fees charged by government agencies or third-party service providers.
Government fees, fingerprinting costs, third-party charges, requirements, procedures, and availability are subject to change.
GuardCard.com does not control government agencies or independent third-party providers and cannot guarantee that their fees, procedures, appointment availability, processing times, locations, or requirements will remain unchanged.
If government or third-party costs increase or requirements change, additional charges may be required where permitted by applicable law and the terms of the applicable product or service.
9. LICENSING IS NOT GUARANTEED
Completion of a GuardCard.com training course or purchase of a Bundle Package does not guarantee that a government agency will issue, approve, renew, or maintain a security guard license or credential.
Licensing decisions are made exclusively by the applicable licensing authority.
Customers are responsible for determining whether they satisfy applicable licensing requirements.
These requirements may include age, identity, background, criminal-history, employment, immigration or work-authorization requirements where applicable, and other eligibility standards established by the licensing authority.
GuardCard.com does not have authority to waive government requirements or guarantee licensing approval.
10. GOVERNMENT PROCESSING TIMES
Any estimated government processing time provided by GuardCard.com is informational only and is not a guarantee.
GuardCard.com does not control processing times of state agencies, licensing authorities, fingerprinting providers, background-check providers, postal carriers, or other third parties.
GuardCard.com is not responsible for delays caused by government agencies or independent third-party providers after GuardCard.com has properly performed its applicable services.
11. FINGERPRINTING AND PHOTO SERVICES
Where fingerprinting and/or photo services are included with a Bundle Package, customers must follow the instructions provided by GuardCard.com and use approved or designated providers when required.
Customers are responsible for scheduling and attending required appointments within the applicable Bundle Package eligibility period.
Availability of fingerprinting locations and appointments may vary by geographic area.
Failure to schedule, attend, or complete fingerprinting or photo services before expiration does not entitle the customer to a refund, credit, or automatic extension.
Fees incurred by using an unauthorized or non-designated provider are the customer's responsibility unless GuardCard.com expressly agrees otherwise in writing.
12. CUSTOMER INFORMATION AND DOCUMENTATION
Customers are responsible for providing complete, accurate, current, and truthful information.
This may include legal name, date of birth, identification information, mailing address, contact information, licensing information, photographs, identification documents, and other information necessary to provide training or licensing-related services.
GuardCard.com is not responsible for delays, rejection, additional fees, or other consequences resulting from inaccurate, incomplete, outdated, or fraudulent information provided by a customer.
Customers are responsible for promptly responding to requests for information or documentation.
13. CUSTOMER RESPONSIBILITY
Customers are responsible for monitoring their course and Bundle Package expiration dates and completing all required actions within the applicable time periods.
Customers are responsible for reading instructions and communications provided by GuardCard.com.
Failure to access an account, monitor email, read communications, complete training, submit requested information, provide identification, complete applications, schedule fingerprinting, attend appointments, or otherwise follow instructions does not extend an expiration period or create a right to a refund.
14. EMAIL AND ELECTRONIC COMMUNICATIONS
By creating an account or purchasing a GuardCard.com product or service, customers consent to receive transactional and service-related electronic communications concerning their account, training, purchase, expiration dates, licensing process, and related services.
Customers are responsible for providing and maintaining accurate contact information and monitoring communications sent to the email address or other contact information associated with their account.
15. INTELLECTUAL PROPERTY OWNERSHIP
All content made available through GuardCard.com, including but not limited to training courses, videos, audio, narration, written materials, text, graphics, photographs, illustrations, presentations, course designs, downloadable materials, forms, quizzes, examinations, questions, answers, instructional materials, website content, software-related content, logos, trademarks, branding, and other educational or proprietary materials ("Course Content"), is owned by or licensed to GuardCard.com and is protected by applicable intellectual property laws.
Purchase of a GuardCard.com product does not transfer ownership of Course Content or intellectual property to the purchaser.
Purchase provides only a limited, revocable, non-exclusive, non-transferable right for the registered student to personally access and use the applicable Course Content for its intended educational purpose during the authorized access period.
16. PERSONAL USE ONLY AND ACCOUNT SHARING
Course access is provided solely to the individual student registered to the account.
Accounts, login credentials, course access, training materials, completion privileges, and other benefits may not be shared, transferred, rented, sold, sublicensed, or provided to another person.
Each student must maintain their own account and obtain their own authorized course access.
Customers are responsible for maintaining the confidentiality and security of their account credentials.
17. COPYING, RECORDING AND DISTRIBUTION PROHIBITED
Except where expressly authorized in writing by GuardCard.com, users may not copy, reproduce, record, download, capture, photograph, screen record, republish, upload, transmit, distribute, publicly display, modify, sell, license, create derivative works from, or otherwise exploit GuardCard.com Course Content.
Users may not reproduce or distribute course videos, audio, narration, written materials, presentations, quizzes, examinations, questions, answers, instructional materials, or other proprietary content in whole or in substantial part.
Permission to download a particular document or resource does not authorize reproduction, redistribution, resale, publication, or commercial use of that material.
18. COMPETING TRAINING AND COMMERCIAL USE PROHIBITED
GuardCard.com Course Content may not be used to create, develop, improve, market, operate, or assist in creating another training course, security guard training program, educational program, examination, question bank, study guide, commercial training product, website, or competing service.
Course Content may not be used for commercial purposes without prior written authorization from GuardCard.com.
19. ARTIFICIAL INTELLIGENCE AND AUTOMATED SYSTEMS
Users may not upload, submit, transmit, provide, scrape, or otherwise make proprietary GuardCard.com Course Content available to artificial intelligence systems, machine-learning systems, large language models, automated content-generation systems, datasets, or similar technologies for purposes including model training, dataset creation, reproduction, redistribution, generation of derivative content, development of competing materials, or other commercial exploitation.
This restriction does not prohibit a student from using generally available technology for legitimate personal accessibility purposes where such use does not reproduce, distribute, disclose, or commercially exploit GuardCard.com proprietary content.
20. TECHNOLOGICAL RESTRICTIONS AND SECURITY
Users may not attempt to bypass, disable, manipulate, interfere with, or circumvent any course progression requirement, course timer, identity verification procedure, examination or assessment requirement, access restriction, security feature, technological protection measure, payment restriction, or other control implemented by GuardCard.com or its technology providers.
Automated scraping, unauthorized bots, credential sharing, fraudulent course completion, or manipulation of training records is prohibited.
21. SUSPENSION OR TERMINATION
GuardCard.com reserves the right to suspend, restrict, or terminate access to an account, course, package, or service if GuardCard.com reasonably determines that a user has:
- Shared an account or course access
- Attempted fraudulent course completion
- Copied, recorded, or distributed proprietary materials
- Circumvented technological controls
- Provided fraudulent information
- Engaged in abusive, threatening, fraudulent, or unlawful conduct
- Violated intellectual property rights
- Misused GuardCard.com services
- Materially violated these Terms & Conditions
Where permitted by applicable law, termination resulting from a user's violation of these Terms does not entitle the user to a refund.
22. COPYRIGHT AND TRADEMARKS
The GuardCard.com name, logos, branding, website, course materials, and associated intellectual property are protected by applicable copyright, trademark, and other intellectual property laws.
Nothing in these Terms grants permission to use GuardCard.com trademarks, branding, copyrighted materials, or other intellectual property except for the limited personal educational use expressly authorized by these Terms.
23. INTELLECTUAL PROPERTY ENFORCEMENT
Unauthorized reproduction, recording, distribution, commercial exploitation, account sharing, or other infringement or misuse of GuardCard.com intellectual property may result in termination of access and enforcement of GuardCard.com's rights and remedies under applicable law.
GuardCard.com reserves all rights not expressly granted under these Terms.
24. THIRD-PARTY SERVICES AND TECHNOLOGY
GuardCard.com may use third-party platforms and service providers to provide training, payment processing, electronic signatures, communications, fingerprinting, application processing, hosting, and other services.
Use of certain third-party services may also be subject to the applicable provider's terms and policies.
GuardCard.com is not responsible for outages, interruptions, appointment availability, processing delays, or other events caused solely by independent third-party systems or providers outside GuardCard.com's reasonable control.
25. TECHNICAL REQUIREMENTS
Customers are responsible for maintaining a compatible device, internet connection, browser, email account, and other technology reasonably necessary to access online training.
Temporary technical problems do not automatically extend course or Bundle Package expiration periods.
Customers experiencing a technical issue that prevents course access should contact GuardCard.com promptly while their course remains active so that the issue can be investigated.
26. CHARGEBACKS AND PAYMENT DISPUTES
Customers should contact GuardCard.com regarding billing concerns before initiating a payment dispute or chargeback so GuardCard.com has an opportunity to investigate and address the issue.
Initiating a chargeback does not alter the terms governing course access, expiration, Bundle Package eligibility, or intellectual property rights.
GuardCard.com reserves the right to provide the applicable payment processor or financial institution with records reasonably necessary to respond to a payment dispute, including transaction information, evidence of course access or completion, acceptance of these Terms, and records concerning services provided, subject to applicable privacy laws.
27. NO PROFESSIONAL OR LEGAL ADVICE
Information provided by GuardCard.com concerning licensing procedures is educational and administrative in nature.
Nothing provided through GuardCard.com constitutes legal advice.
Customers with questions regarding how laws, criminal history, immigration status, eligibility requirements, or other individual circumstances affect licensing eligibility should consult the applicable government agency or a qualified professional.
28. CHANGES IN LAW, REGULATIONS OR LICENSING REQUIREMENTS
Security licensing laws, regulations, training standards, government fees, fingerprinting requirements, application procedures, and other requirements may change.
GuardCard.com may update its courses, procedures, pricing, services, and requirements when reasonably necessary to reflect changes in law, regulation, government policy, third-party requirements, or operating costs.
Nothing in these Terms guarantees that government requirements or third-party costs will remain unchanged after purchase.
29. LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, GUARDCARD.COM AND ITS OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO USE OF GUARDCARD.COM PRODUCTS OR SERVICES.
THIS INCLUDES, TO THE EXTENT PERMITTED BY LAW, LOST EMPLOYMENT OPPORTUNITIES, LOST WAGES, LOST PROFITS, LICENSING DELAYS, GOVERNMENT PROCESSING DELAYS, THIRD-PARTY DELAYS, OR A GOVERNMENT AGENCY'S DECISION TO DENY, DELAY, SUSPEND, OR REVOKE A LICENSE.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, GUARDCARD.COM'S AGGREGATE LIABILITY ARISING OUT OF A PARTICULAR PURCHASE WILL NOT EXCEED THE AMOUNT ACTUALLY PAID TO GUARDCARD.COM BY THE CUSTOMER FOR THE PRODUCT OR SERVICE GIVING RISE TO THE CLAIM.
Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited.
30. NO GUARANTEE OF EMPLOYMENT
GuardCard.com does not guarantee employment, job placement, wages, work assignments, or employment eligibility.
Completion of training or issuance of a security guard credential does not guarantee that any employer will hire the student.
31. INDEMNIFICATION
To the extent permitted by applicable law, users agree to indemnify and hold harmless GuardCard.com and its owners, officers, employees, contractors, and agents from third-party claims, damages, liabilities, and reasonable costs arising from the user's unlawful conduct, infringement of third-party rights, unauthorized distribution of GuardCard.com intellectual property, fraudulent activity, or material violation of these Terms.
32. GOVERNING LAW
These Terms & Conditions and any dispute arising from or relating to GuardCard.com products or services will be governed by the laws of the State of Arizona, without regard to conflict-of-law principles, except where applicable law requires otherwise.
33. DISPUTE RESOLUTION AND VENUE
Before filing a legal action arising from a purchase or use of GuardCard.com services, the customer agrees to make a good-faith effort to contact GuardCard.com and provide a reasonable opportunity to resolve the dispute informally.
Unless applicable law requires otherwise, any court proceeding arising from or relating to these Terms or GuardCard.com services shall be brought in a court of competent jurisdiction located in Arizona.
Nothing in this section prevents either party from pursuing remedies that cannot lawfully be restricted by contract.
34. CHANGES TO THESE TERMS
GuardCard.com may update these Terms & Conditions periodically to reflect changes in services, laws, government requirements, technology, or business practices.
The version applicable to a particular transaction will generally be the version presented or made available to the customer at the time of purchase, except where subsequent changes are required by law or expressly accepted by the customer.
The "Last Updated" date at the top of this page identifies the most recent revision.
35. SEVERABILITY
If any provision of these Terms & Conditions is determined to be invalid or unenforceable, that provision will be enforced to the maximum extent permitted by law or severed where necessary.
The remaining provisions will continue in full force and effect.
36. NO WAIVER
Failure by GuardCard.com to enforce any provision of these Terms on one occasion does not constitute a waiver of that provision or GuardCard.com's right to enforce it in the future.
37. ENTIRE AGREEMENT
These Terms & Conditions, together with any applicable product description, checkout disclosures, Privacy Policy, Refund Policy, and other policies expressly incorporated by reference, constitute the agreement between the customer and GuardCard.com concerning the applicable purchase and use of the services.
38. ACCEPTANCE OF TERMS
By creating an account, enrolling in training, purchasing a product or service, or checking the Terms & Conditions acknowledgment during checkout, you acknowledge that you have read, understood, and agree to these Terms & Conditions.
You specifically acknowledge and agree that:
- All purchases are final and non-refundable, except where otherwise required by law.
- Training Only means training and training verification only and does not include state licensing services, applications, fees, fingerprinting, photos, or other licensing services.
- Training Only customers are responsible for knowing, verifying, and completing their state's mandatory licensing process.
- Training access is generally limited to 30 days from the original purchase date.
- Training that expires before completion requires payment of the applicable reactivation fee to restore access.
- Reactivation fees vary by product.
- Reactivating training does not automatically extend Bundle Package eligibility.
- All Bundle Package services and fees expire 60 days after the original purchase date or 30 days after completion of training, whichever occurs first.
- Unused Bundle Package services and fees are non-refundable after expiration.
- GuardCard.com does not guarantee issuance of a security guard license or employment.
- GuardCard.com Course Content and intellectual property are provided solely for authorized personal educational use.
39. CONTACT
Questions regarding these Terms & Conditions, purchases, course access, or GuardCard.com services should be submitted through the contact methods provided on GuardCard.com.
